It is a long debated topic: is CBD oil legal (UK)? Well, yes, CBD is legal here. It is legal to produce, sell and consume CBD products. Despite this, the CBD industry is heavily regulated and confined by legality. For those of us that sell and market CBD products, we have a robust set of guidelines that we all have to abide by. It can get a bit complex but let us break it down for you.
Is Hemp Oil Legal in the UK?
Cannabis is documented in the Criminal Misuse of Drugs Act 1971 and the germination and growth of any cannabis seed are prohibited by law. The two important parts of the cannabis and the hemp plant (in this discussion) are CBD and THC. While THC is a banned substance within the CMDA (The Misuse of Drugs Regulations 2001), CBD is not. Out of the two variants, hemp has a much higher concentration of CBD and therefore makes it a perfect plant to produce CBD products.
There has been some discussion in reports on this subject that the EU permits CBD containing 0.2% of THC or less. However, after a review of the appropriate regulations (Article 52 of Regulation (EC) No 1782/2003) they appear to be concerned with the cultivation of hemp rather than products produced from the hemp. For this reason, they are unlikely to be applicable to CBD infused hemp oil.
More closely to whether Hemp oil is legal in the UK, the Misuse of Drugs Regulations 2001 (‘the 2001 Regulations’) is assumed to permit a small amount of THC in a product, but this idea is simply due to a lack of clarification in the regulations. So is hemp oil legal in the UK? Yes, but the UK CBD laws sorely need to be reviewed to add clarification on a few key aspects of hemp oil legality. Cannabis Oil (UK Law)
Cannabis oil UK law is exactly the same as the law that determines whether hemp oil is legal (UK). The cannabis plant has a higher concentration of THC in its biological makeup. This creates a challenge for producers trying to comply with Cannabis oil UK Law. It means that a higher concentration of THC in Cannabis oil is a bigger risk than in Hemp products. Therefore to comply with cannabis oil UK law, it is imperative that we know what is in the bottle. It is not an easy defence to suggest that a provider honestly has no knowledge of the concentration in the bottle- this becomes a particular issue if the CBD oil is sourced outside of the UK. Marketing and Sale of CBD
The legal body that governs CBD oil is the Medicines and Healthcare products Regulatory Agency (MHRA) and issued a statement on the 3rd of October noting that CBD will be designated as a medicinal product and therefore is now subject to regulation. Therefore, unlicensed suppliers were to discontinue sales within 28 days. In a clarifying statement, 10 days later, the MHRA stated this as 'an opinion' but reinforced that only CBD that was marketed for medical purposes will be classed as a medicine by the UK regulatory body. These medicinal products would now require regulatory approval for use of any medical claims.
(Deep breath) It is all a bit confusing. For that reason, many people believed that CBD oil was no longer available. This could be a reason why people ask; Is CBD Oil Legal in the UK?
What this means is to make medicinal claims on any CBD products, a company must be licenced and must be given authorisation by a regulatory body. Simply to sell CBD we must abide by the regulation around CBD product quality and safety specifications and marketing protocol.
